Terms & Conditions – Symbolic Image Photography

1. Services

Symbolic Image Photography (“Photographer”) agrees to provide photography services as outlined in each individual booking. The scope of work, deliverables, and timeline will be defined per project.

2. Booking & Payment

  • A refundable deposit of 50% is required to secure all bookings.

  • The remaining balance is due prior to delivery of final images, unless otherwise agreed in writing.

  • Photographer reserves the right to withhold delivery until full payment is received.

3. Late Payments

Payments not received within 14 days of the due date will incur a $50 late fee.
Any outstanding balance thereafter will accrue interest at a rate of 1.5% per month (18% annually) until paid in full.

4. Cancellations & Rescheduling

  • Cancellations less than 24 hours of the scheduled shoot may result in forfeiture of the deposit.

  • Rescheduling is permitted with reasonable notice and is subject to availability.

  • Photographer reserves the right to reschedule due to weather, illness, or unforeseen circumstances.

5. Usage Rights & Licensing

  • All images remain the exclusive intellectual property of the Photographer.

  • Clients are granted a limited, non-exclusive, non-transferable license for agreed-upon use (e.g., MLS listings, marketing, website use).

  • Images may not be sold, transferred, or shared with third parties without written consent.

  • Additional licensing is required for extended or commercial usage beyond the original agreement.

6. Turnaround Time

  • Standard delivery is [1-2 business days] after the shoot.

  • Expedited delivery may be available for an additional fee.

7. Image Delivery & Storage

  • Images are delivered via digital download or online gallery.

  • Photographer is not responsible for long-term storage of files. Clients are responsible for downloading and backing up images promptly.

8. Editing & Creative Control

  • Photographer retains full creative control over composition, editing, and final image selection.

  • Additional retouching or revisions beyond standard editing may incur additional fees.

9. Client Responsibilities

  • Client agrees that the property or subject will be clean, staged, and ready at the time of the shoot.

  • Delays caused by unprepared conditions may result in additional fees or reduced coverage time.

10. Access & Permissions

  • Client is responsible for securing access to all areas to be photographed.

  • Any required permissions, permits, or approvals must be obtained by the client prior to the shoot.

11. Travel Fees

  • San Diego County Region is included.

  • Travel beyond this range may incur additional fees, disclosed prior to booking.

12. Limitation of Liability

  • Photographer is not liable for circumstances beyond control, including but not limited to:

    • Weather conditions

    • Restricted access

  • In the unlikely event of total failure to deliver images, liability is limited to a refund of payments made.

13. Model & Property Release

  • Photographer reserves the right to use images for portfolio, marketing, and promotional purposes, unless otherwise agreed in writing.

14. Independent Contractor

Photographer operates as an independent contractor and is not an employee or partner of the client.

15. Governing Law

These Terms & Conditions are governed by the laws of the State of California.

16. Agreement

By booking services, the client acknowledges and agrees to these Terms & Conditions in full.
